Recently
I opined that the Supreme Court ultimately got it right in deciding
Locke v. Davey. Today on Findlaw, Walter Weber
takes the opposite view. That's not surprising, given his position as Senior Litigation Counsel for the American Center for Law and Justice (Pat Robertson's answer to the ACLU). What is surprising is that I generally agree with Weber that the holding in
Locke is fairly narrow and shouldn't have great ramifications beyond the current case.
