National Review Online today has an
interesting column about the Supreme Court's dilemma in the
Newdow case. As the author points out, the Court pretty much has two choices: affirm the Ninth Circuit ruling taking "under God" out of the Pledge of Allegiance, based on fairly clearly established precedent, or overturn the Ninth Circuit by, basically, clearing all the precedent away. Both options have their problems.
